Authorities were called late Thursday afternoon to the 8900 block of East Eden Road in east Eden after a man allegedly killed his 79-year-old mother.
Wayne E. Kozak, 48, of the East Eden Road address, is accused of fatally shooting his mother, Mary Louise Kozak, 79, who lives in the same house. Mary Kozak was found dead at the home just before 4 p.m. Thursday.
Officials with the State Police, the D.A.’s office, and Eden Police credit good collaboration between the local agencies and Pennsylvania State Police with allowing them to quickly find their suspect. Late Thursday night, Pennsylvania State Police located Wayne Kozak at a motel in Erie, Pennsylvania. After a judge in Erie County, New York, signed an arrest warrant. Using the arrest warrant, Pennsylvania Police were able to enter the room and take the suspect into custody without incident.
As of late Friday, Kozak was being held in Erie, PA on an arrest warrant, awaiting a hearing in Erie city court about whether he will be extradited to western New York to face a 2nd degree murder charge here. He’s due in court on Monday. Erie County DA John Flynn said Kozak may fight being extradited, but that it is rare.
Wayne Kozak allegedly killed his mother less than a week before his 49th birthday, records show, but officials say it is too early in the investigation to comment on a potential motive.
This was the first murder in Eden in more than 30 years, Eden Police Chief Mike Felschow said. The last involved John Pinelli, a Buffalo man who was shot execution-style and found on Sept. 29, 1986, in a field off Jennings Road. Felschow said the community was shaken by the news.
“It gets around usually very fast in a small community like that. And this did. Once people found out, it did, it got out,” he said. “It affected a lot of people, cause up there, a lot of people are related in that area, a lot of family up there.”
